Selling and smog cert law

Did the law change as of the first of the year requiring the seller to supply a smog cert/proof at the time of the sale on vehicles older then 4yrs?

In the past it has been that the seller was responsible for the vehicle passing smog. Meaning you couldn't sell a vehicle that would not pass or if you did you were responsible for the costs to make it pass.

It does say this on the CA DMV webpage. I guess they are getting into the subscription business even more. Don't sell within 90 days, repay retry.

You are correct, the law does say the seller is responsible for smogging the vehicle. You can, however, sell the vehicle without having it smogged, IF the buyer agrees that it will not be smogged and he/she will smog it at a later date. Be advised though, if the buyer somehow can't get the vehicle smogged, you are still legally responsible for the smog test.
