This has come up before, are you sure doing this is legal? I mean everyone is having a hard time selling boats right now, if it was legal why aren't more people doing this?

I got my tickets.Mark has a great TV show on the sportsman channel and the tickets are tax deductible because a portion of the ticket sales goes to the Children's Miracle Network.

Anyone know the legalities of this? I realize this particular auction is not in Ca. but I'd think a lot of guys would be doing this to off boats that aren't selling right now if it was this easy.

It is a sweepstakes, which presumably means for every $20 donation you receive one chance to win a prize. There are usually risks associated with this type of giveaway, as there needs to be enough entries to make it worthwhile to offer up the prize(s). There are a number of these that have been conducted here in California over the last few years, with the grand prize being a home. Pretty good deal, if you're the winner.

From all appearances, this is partially a charity event with a portion of the proceeds going to the Children's Miracle Network. Can't tell what portion, but if it is deemed a charitable event then it may qualify as a tax-deductable donation (you should check with your tax advisor to be certain).

If you're feeling lucky, enter the drawing. If not, then don't. Mark is a legitimate personality in the bass world, so all indications are that this is a legitimate offer. Tony is aware and made the call, based on the fact that it is supposed to benefit a charitable organization.

Maby the reason knowone else has done this could be because they dont have nuts . this is legal and the drawing will be done on land owned by the Choctaw nation of Oklahoma i am trible memmber and i hav their support . the bottom line is if do not sell enough tickets to cover the cost of the boat and additional prizes i loose and the money will come out of my pocket . so im asking for your help . sorry for the confusin on the web address and please overlook my spelling i flunked it in school because i was fishin

Just off the phone with Mark Goines and it all sounds completely legitimate. $20 gets ya a shot at that boat. Dec 19 is when the boat will be awarded and it'll all stream live on the internet so even if you're out here on the West Coast you'll be able to see how it all unfolds.

Sounds like fun and for a good cause as well!

Anyone know the tax implications of such an event. You are technically "buying" the boat for $20.00, but you are also "winning" the boat. So is it taxed as income?

the boat and motor has not been titled so whom ever wins will be the orgional owner and will pay taxes . i would say whome ever wins this boat their will be someone that will make a cash offer and the winner would never have to hook on to it my dealer will be present at the drawing with his cheek book

My Dad has been jerked around my the US Government for 30 years and they keep making it harder for us to get all the paperwork completed properly because they bury it in the ancestry library in Fort Worth Texas.

Here is a question about the tax thing. Im noly 20 so I dont know exactly how it all works. But if you buy the ticket and WIN the boat for 20$ isnt it then only VALUED at 20$ so even a 50% tax rate would be 10$? If so then the income tax problem really wouldnt be a problem.

LOL, I like your thinking Jason! I'm pretty sure the IRS would disagree with you though. Taxes on a "prize" is much higher than "normal". But, like I previously stated....let me win the boat....I'll cross those bridges later! No matter what the taxes are....I'm still ahead. I've already got my tickets.

Would you pay taxes based on CA law or Arkansas law? Also would you pay taxes on the Fair Market Value (FMV) or the Approximate Retail Value (ARV) of $60,000 listed by the sponsor?

If you win a boat and motor based on a $20 investment I'd think you'd be WAY ahead of the ballgame to handle whatever tax considerations might come up. We are talking about a Z520 and motor aren't we? It would depend on whether the winner actually keeps the boat and motor and if that winner sells it he'd likely be paying taxes on what he sold the combo for which means the transaction basically pays for itself. If the winner keeps the boat then they'll be getting a boat and motor for $20 plus the taxes which can't amount to much more then 4 or 5 grand. I don't know of anywhere on the planet you could pick up that boat for less then $8k.

It's a pretty good value no matter how you look at it to my mind.

I think on a contest or lottery the government will demand taxes paid on the retail value of a new boat since it has not been registered to an owner. That could be a sizeable chunk of change. Remember when Oprah gave the audience a new car and people freaked out when they realized the tax burden?

Assume that whoever the winner is would be paying taxes for it in the state they register the boat in which is likely the where ever they live.

I still think paying the taxes plus $20 is a pretty good deal for a quality boat and motor. Just my opinion and lord knows I can be and am often wrong, hahaha.

The catch to this is...

Do you "win" the boat? Which would make it income (gaming and prizes) like winning at a slot machine in a casino. Last time I won achunk of money at a casino in CA the taxes were 39% (if my feeble brain remembers correctly)

or did you purchase it for $20? Then you would only be liable for Sales Tax (must be paid before you can register the boat and the fine for using a non-registered watercraft in CA is pricey) and Property Tax. I don't think CA would let you use $20 for the purchase price and would probably want Sales Tax on the MSRP.

sTony is right if you only have to pay Sales Tax and Property Tax, this is win situation-the price of the ticket(s) and few thousand dollars in taxes for a $50+ boat. If however you have to report the MSRP as winnings (income)...hold on to your wallet.

No one here is likely to be able to accurately tell you what the deal would be if you won. If I won the boat I'm pretty sure I'd turn around and sell the boat at a super deal to some other lucky person and walk with a fair amount of cash regardless.

Seems like a no brainer to me. $20 would likely either give you a super great deal on a great boat or put a some cash, still likely 4 or 5 figures, in your pocket after a sale. I still don't see how you lose on this deal, it's a matter of how much you'll eventually bank any way you look at it.

Just got mine, chance to win a boat and help out a good cause that helps kids, this was a no brainer. If you dont already think about helping out those less fortunate than yourself. We all talk about it this time of year but we should try to do it year round if we can.

Go to your local malls and bring a toy for the toys for tots program the Marine Corps does every year. Does not have to be much, just something.

This deal has been going for a couple of years now and Joseph sounds like a Nigerian scam artist. You sold $20000 worth of tickets for a 2006 boat and now you want another $24000 to break even? Good luck but I doubt anyone following this mess from the BBC and other sites will jump up to "have your back". Good luck.

Hey all. Long time no see. Just wanted to pop in and say that I just got off the phone with Mark Goines and we were talking about this "Joseph" thing. Unfortunately, bad people do bad things to good people, and Mark is good people and one hell of an angler. I also had unfortunate dealings with Joseph, but nothing like what happened to Mark. Joseph fooled a lot of people. The bottom line is that Mark and myeslf are NO LONGER associated with Joseph Trousdale or his "websites" (Which by the way no longer exist) and Mark is planning on persuing criminal charges. Anyway, the raffle is real and the boat is real. I wish all of you ticket holders the best of luck and those of you who are thinking about or have not bought a ticket yet, better hurry, time's running out!

I read on another site that you guys started this thing over raising money for a pizza delivery guy who was killed and the family needed money. Later it became an Angler's Resource gig for Children's Miracle Network with the same boat. The original deal was a store sweepstakes then it became a straight boat raffle. You may think the Joseph deal is over but Mark helped him to sell 700 tickets to fisherman and those tickets and information are gone so that is $14000 from guys who have no chance to win a boat. This deal took advantage of good hearted fishermen all over the country and is shameful.

THIS MAY HELP CLEAR THINGS UP, FOUND THIS ON ANOTHER SITE....

Well guys I spoke with Mark Goines today for about 30 mins about this raffle for the boat. This is what happened and this is what is being done. Joseph at Anglers Resource started the contest without a real boat to give away, he had hoped (I think) to raise enough funds to purchase the boat. Anyhow after he realized he wasn't going to make he called Mark asking him to take over the giveaway. Mark agreed and well now comes the good part. He sent mark all the names of the individuals who purchased tickets about 400 at $20.00. So after receiving the info Mark asked for the money that came from those entries and well let’s just say he didn't get it. Joseph seems to be on the run with about $14,000 in entries. Of course this happens after Mark has sworn his name/reputation to this giveaway. So after talking with him he said he was going to honor all those who had paid prior to him taking over. He also said the boat being given away is his and he guarantees’ it will all be done by the contest date. Guys he has long up standing reputation in the fishing industry so I doubt very much he will not follow through.

So please I know times are tough but he has about 1000 entries left to sell, Just for him to break even. We all know how much his boat costs plus all the other bonus prizes being given out. So please I know it Christmas time but if you can afford it please enter the raffle the worst thing that could happen is you could win a boat. $20.00 an entry isn't bad and well I think guys like him are hard to find and well worth an investment. By the way after hearing this story I bought 5 more tickets and no I am not made of money in fact I am SSgt in Air Force. For those of you that have served Thank You and you know how much I don't make.

OK , Here is what I have decided to do.
I have a list of the people that bought tickets from Angler's Resource and even though I do not have the moneys for the tickets that Angler's Resource sold I am still going to make good on all of those tickets.So if you bought tickets from Angler's Resources you will still be in the drawing and have not lost your money.Good Luck the drawing is Dec. 19th. AS far as Angler's Resources goes,He is going have his day in court.

I just got off the phone from speaking with Mark in great detail. He answered each and every question that I had in reguards to raffle, the boat, & the prizes, & to that worthless scumbag that burned him for $14,000.
Completely satisified, I also just purchased my tickets for the raffle.
Let me say this. Mark is honest & truthfull man, that was CON'D out of alot of money. To still honor those tickets that were sold, & not recieve the money for those tickets, I think says VOLUMES about his character. There have been NO changes, & the raffle will be on December 19th. Mark also told me that the raffle will be filmed & posted on U-TUBE, his website, and numerous others.
Nothing would make me a better Christmas present than to win a 2008 Ranger Z520. Now I hope no one else buys a ticket to increse my chances,,, LOL J/K ...Clay Sutterfield
