IF U MUST KNOW I WORK AT THE ANTIOCH MARINA AND I SAW SOMEONE THAT LOOKED LIKE ISH FISHING IN THE MARINA.AS YOU COME IN THE MARINA FROM THE WATER IT SAYS NO FISHING IN THE MARINA.MY BUDDY WHO WORKS WITH ME WENT DOWN AND TOLD THEM THERES NO FISHING IN THE MARINA AND THEY TOLD HIM THE SHRIFF TOLD HIM HE COULD FISH HERE AS LONG AS HE DIDNT TOUCH THE BOATS OR GET ON THE DOCKS.NO FISHING MEANS NO FISHING.I THOUGHT ALL THE BIG WIGS FOLLOWED ALL THE RULES.I ASLO HAVE A NICE PICTURE RIGHT BEFORE THEY LEFT.ALL IM SAYIN IS FOLLOW THE RULES.THERE 50 MARINAS UP AND DOWN THE DELTA WHY PICK THE ONE THAT SAYS NO FISHING.FISHING MUST BE GETTING SLOW IF YOUR HITTIN THE HARBORS AND THERE ARE SOME NICE BASS IN HERE RIGHT NOW WITH ALL THE SHAD HERE.JUST WANTED 2 KNOW IF THERE WAS A TOURNAMENT 2DAY.TO BE HONEST I COULD CARE LESS BUT THE HARBOR MASTER IS A REAL A**HOLE.HE MAKES ME DO THE DIRTY WORK.I JUST WANTED TO SEE HIM CATCH A FISH SO I COULD SEE WAT I MISSED YESTERDAT AFTER WORK.......

Is this a rule for the harbor that the harbor master decided to make or is it a law enforced by the Sherriff or F&G?

Well offhand I think your online moniker is half right. If I put a sign out on mys treet that says 5 mph can I ticket folks who drive by at 25 mph? Your friend at the marina does NOT own the water in the marina. The state and people of California do. The laws specifically protect our rights to use those waters for recreational fishing.

Ish or not the signs that say no fishing in the marina would be from the docs if it is Navigable water then guess what, free access baby

And to go a bit further, if you dredge out or create a marina, and inlet the the public waters unto private property, guess what?

You have created a public access.

Ish is a good dock fisherman. Hope he gets bit.

Which marina is it? I think I just found my new favorite place to fish.

It wouldn't be that marina just west of Lauritzen's would it?

I have seen a sign going into Driftwood Marina (I think thats the name) that says no fishing. Its on the east side of the Antioch bridge. I have heard that the only one you can't fish in is the Antioch Marina because of some city ordinance but that is just what I heard. I can't see how someone can't prohibit fishing from public water ways.

first off im not knockin ish or who ever that was fishing today.i would love to see guys like ish come in and fish.i de like to sit back and watch and try to pick up a few things.the harbor master hates us fisherman and would love to get one of us in trouble.early this hear he got the CF numbers of a bassboat and called all the local marinas and try to DQ a guy for fishing in" HIS MARINA"he need to focus on work and not on the guys enjoying his day off.....

The Antioch Marina is one of the few places where it may not be OK to fish..... due to city ordinance........ or so I've heard,, never been there myself........ It would be interesting to find out if anyone has ever challanged a citiation (or if any have ever actually been issued for that matter) based on it being a navigable state waterway

Like you Jim, I've never heard of anyone getting a citation. Makes me wonder Just who would have the jurisdiction to citate anyone of us for fishing public water owned by the state. I'm pretty sure that if the city of Antioch passed an ordinance, It must be posted on the sign, and it could only be for fishing from the shore. If my lady takes a later flight tommorw back from Vegas, I just may have to go and challenge this one in the morning .....Clay ;-)

It is. It says right on the sign "city ordinance" and had the number right on it. It has been like that since it was built about 20 years ago. I used to fish down there as a kid before there was a marina there. They let people fish off the bank in there and dont want the bass boats blocking the gas dock which is illegal to fish with in 50 ' of it any way. Dest bet is just to stay out. They do not want us in there. Why make it into a pissing match and give them a worse view of bass fishermen? There is still 999 miles of Delta to fish.

It's a city law, so guess what ? It's the law....... THe sherrif will cite you, you could be DQ.ed pay a fine etc etc
I've heard some TD's say it's off limits becauce of the city ordanance..

Well if you want to take the time to get a city ticket, get DQ'ed, and go to court and fight it, be my guest. I think I will just find another place to fish.

In some instances, a city ordinance can trump state law..In this particular case I am not so sure, but as Mike says, there are a lot more places to fish, so why take the chance..

"Navigable water", is actually a delegation of federal regulations.
And yes, State (Brannon Island Swimbeach) and City Ordinances(Antioch Marina), can be implimented to overide said Federal regulations. Can you get cited in either of these two places? ABSOLUTELY! Both are clearly posted and policed regularly. Every bass fishing tournament, I have ever fished the past 15 years, make special note of those two locations as off limits.

Yeah, the Antioch Marina and Brannan Island were the two I've always heard were definately off limits..... It was more just a curiousity thing about anyone ever challenging a cite......

Now the handfull of dock owners who think they own the water and like to hoot and holler anytime you fish near em is another story.............. they just get ignored as well they should

but how bout some of the other marina's,, like Spindrift and a few others, as was mentioned above,, there's a "no fishing" sign at the entrance,,, I was always under the impression that the navigable waterway thing applies more than a private marina owner's wishes

Of course respecting others property and keeping off private docks should be a no brainer along w respect for the rules and ordinances ect.... but I don't buy into the "they don't want you there" and the "what will they think of bass fisherman" point of view.......... Heck, ask any PETA member and I'm sure they's all agree they don't want us fishing at all...... should we respect their opinions too???? Don't think so

now most times it's easier and wiser to just avoid those confrontations (most times I do),,, especially if yer just fun fishing.... but in all other areas (excluding those specifically off limits),, we as fisherman have just as much right to the water as those few individuals who don't want us near there docks.... Do you think those yahoo's ever worry about what bass fisherman will think of them ??? It's public water

as always, common sense needs to be rule #1... we've all seen/heard of situtations that went terribly wrong due to a someone's ego and a few too many drunken idiots............ don't make the 6 O'clock news just to be right :lol: :lol: :lol:

So now what happens? Dont know for sure if it was ISH this guy is claiming it was and he was in violation of the rules. Any greivance, what?

I guess the reason Fish n Fool that you got heat on this thread is the way you setup the conversation.... you could have said Hey Guys reminder this area is off limits and you will be citied and DQ'd .

Unless they reached the TD and filed a protest withing 30 minutes of the weight in there is not much that can be done. In some cases if a TD recieves a complaint they will talk to the anglers and make sure they understand the complaint and how he feels it falls into the circuits rules. Since he is not sure if it was Ish/Zack I don't think there is anything to do. In the future they should take the CF numbers and call Russo's and have them pass the complaint onto any TDs that are running a tournament that day.

And dont you thimk that speed limit signs and no fishing signs should have some kind of official lettering on them as do our traffic siigns on the streets and high ways. Or as One other guy said can I just go out and make it a 5 mile an hour speed lomit on my street?

Now I will be the first to admit that the local regulation regarding Antioch Marina caught me by surprise. I missed that from the original post. Some of the posts by the Northern folks here had me wondering so I looked up the actual rule. (SoCal guy here) Couple of interesting things. Number 1 is that the friendly harbor master is doing us a favor by asking us to leave. He could be issuing citations and he is fully empowered to do so. Here is the city code as it is written.

§ 7-6.19 FISHING.
(A) No person shall fish in the marina from any vessel, float, structure, or roadway. Fishing shall be restricted to the shore line of the San Joaquin River.

(B) All fish shall be disposed of within eight hours after the time of catching. No person shall throw fish or bait overboard at the dock or from a vessel in the marina. Fish cleaning shall not be permitted on vessels, floats, or in any other area of the marina, except as designated fish cleaning areas.

('66 Code, § 7-6.19) (Ord. 704-C-S, passed 4-21-88) Penalty, see §§ 1-2.01 et seq.

§ 7-6.20 ENFORCEMENT.
This chapter may be enforced by officers of the Police Department, the Code Enforcement Officer, and the Harbor Master. In so doing, the Harbor Master shall have all the powers designated by Cal. Penal Code § 836.5.

Interesting read.....I tend to look at it a bit different I guess. To me the legality of fishing in the marina is one issue, but the issue that effects tournament anglers dirrectly is the rules established by the given tournament on that body of water. Rules are put into place to protect anglers...we may not agree with them, but as long as everybody has to follow the same rules and guidlines, it makes that portion of the competition even. If rules are broken knowingly or unknowingly, competitor should be penalized.....don't know that Ish or anyone else broke the rules, just too often any more you here of things like this. Snagged fish, fishing off limits, caged fish.....we need to police ourselves so we can continue what we enjoy doing. take it for waht it's worth.....

Yes most of the tournaments have specific rules and they will tell you what they are at the draw. But tournament fishermen should either go online or ask the tournament organization to mail a copy of the rules to them. All tournament orgs do not have all of the same rules.

One thing to remember is that ignorance of the rules is not excuseable

That having been said, when you are not in a tournament the rules are different and In practice before a tournament I have fished places that could be off limits during the tournament, such as docks in order to help me establish a pattern.
