another guy didnt read the sign.....

after seening a guy fishing here in the antioch marina today (sunday)another guy dicided to come in and fish .i guess he didnt read the last post i started.a new z-21 ranger black and white with yellow seats.hes lucky im alone today and the harbor master isnt here.i hate telling the bass guys to leave the marina.read the signs.there is a city code that says no boats shall fish in the marina that was passed 4-21-1988.

He is lucky? What is the worst case senerio?From the sounds of your last thread and this one you are just a young man(probibly a teenager) trying to become part of the game.Do yourself a favor and take your lunch and break times and do alittle fishing and stop be so worried about what others are doing.Nobody is being hurt by these guys fishing this marina.Now go catch some fish then come back on here and give us a report on how you did.GB..Jim

F n F, don't let a little authority go to your head. If it is against some city ordinance to fish in that marina, the local law enforcement agencies are probably up to the task of enforcement. You sound as tho you take it personal. Relax, no one is getting hurt.

i really dont take it personal im just trying to save everyone a time and money when it come to following the rules.i just hate that the harbor master doesnt go down on the docks himself and talk to the boaters.im the one that gets yelled at by the bass guys.dont kill the messanger......

How about you do me a favor. Next time your out near the sign, write down the city ordinance number & everything that is written on the sign, then post it on here. I'll be happy to access the Antioch Police Dept web site and due the reasearch to see if it's legimate...Clay

Oh, it's legite Clay. That maarina at Humphries and the Brannon Island Swimbeach, are two well know area that are off limits to fishing and boating access. It is indeed the law. Don't waist yer time, keep fishin! HAR! HAR! HAR!

leachman maybe u should learn how to use a baitcaster before you go telling people about getting into the "game" as you call it.....

Jurisdiction over navigable waters belongs to the federal government rather than states or municipalities.

Attempting to address years of problematic litigation, the U.S. Supreme Court in 1979 created four tests for determining what constitutes navigable waters. Established in Kaiser Aetna v. United States, 444 U.S. 164, 100 S. Ct. 383, 62 L. Ed. 2d 332, the tests ask whether the body of water (1) is subject to the ebb and flow of the tide, (2) connects with a continuous interstate waterway, (3) has navigable capacity, and (4) is actually navigable. Using these tests, courts have held that bodies of water much smaller than lakes and rivers also constitute navigable waters. Even shallow streams that are traversable only by canoe have met the test.

Hugh, yes Policeman dis is da harbor master. I need to report a guy fishing it looks like ish, i have da sign up no fish, but ish he keeps on fishing and and I got the sign and I told him read da sign but i, ugh I posted on westernbass that there is a sign and then someone else fished so I posted again.....

in my last two post there has been 36 comments about it.how many other guys read it and didnt post anything?if you didnt know about the off limits you do now.if i help 1 guy not get a stupid ticket then i did my job.im on your side like robin hood. steal from the rich and give to the poor.(old bass fisherman)

Don't kid yourself F-n-F... I've been reading it because it's been a pretty funny thread so far. I especially liked the "Office Space" reference from Ash.

Personally I'd probably avoid fishing it if it had an official looking sign saying it's off limits, but I could care less if someone else wants to give it a shot. It seems like a pretty "victimless crime" in the big scheme of things.

I cannot count the number of tournament meetings I have been through where the off-limits have been read and for the Delta they have always been the Antioch Marina, the swim beach at Brannon Island and within 50 yards of any gas dock. We can argue the legality of these two area, but in many circuits you fish in these two areas and you can be DQed. I know people have been DQed for casting into the Brannon Island off limits area before.

Yup, and I remember a WON Pro-AM, where no less than 5 guys got DQ's fer fishing inside that swim beach zone at Brennon Island. I even got DQ'd once on a pea soup Winter foggy day in a club tournament, inadvertantly drifting to far into that Swimbeach area. First time the club had launched outta there, I didn't know better and was just waiting around for the fog ta lift. I was kinda dumbfounded that nobody else took advantage of the tranquility and safety of that cove first thing in the fog. I later learned why and lost my winning sack of fish to a DQ, and none of those fish were even caught in there! HAR!

I don't know how it really works Monty, but a City Ordinence was implimented. It's there, it's real, it's legit and it's posted. Therefor, boaters and Fishermen need to abide by it or suffer the consequences.

Thanks Cooch. I've also seen for years the off-limits for tourny guys posted and announced. Too many other places in the delta to catch fish than to worry about one marina.

me and my partner feel you cooch. we fished in the anglers choice this weekend at berryessa. had 14 lbs with big fish goin 4.15 or so. got dq'ed because someone said we werent wearing our life jackets 50 yards from the weigh in. sucks we had the winning sack and big fish. just got caught up because we were fishing a tournament.

I don't know if this is just about one marina that got away with not allowing people to fish, it could one day be about ALL the other marinas not allowing people to fish!

Yeah, I'm no lawyer so I could be full of it here, but I would think that the only reason that ordinance is still in affect is that no one's challenged it in a higher court.

Of course... that would take a lot of money so no surprise it still stands.
