Lead Law Question?
Just wondering what the deal is with the new Lead Law in California? Someone just told me that it is now illegal in California to sell lead weights, tire weights, etc.
Don't ask about my username, all I need to say is check yours and check them often.

i was on tackle b.p.s. site and was looking at some owner beast weighted swimbait hooks and the was a disclamer about not being able to ship to california and 1 other state ? not sure what the deal, so i did not order them

I made a order a couple days ago from BPS and all's I saw was a lead warning but they are still shipping to Washington. I do know that my state is trying to ban lead in some areas. And I already have to use steel shot in a lot of places when bird hunting now. Go down hill fast up here. The reason Washington want's to banned lead here is "supposably" to protect the "loon". BUT I think there is only 7 cases of loons dying from lead in the past 10 yrs?

BPS has not shipped lead to Cali for years but they sell it in the stores. We should find out shortly what they are going to do in Washington. Luckily there was a lot of push back to the fish and game commission and they backed off quite a bit. It really helped that many of their own employees were against it. There are a couple of states that have outlawed certain lead fishing gear or have completely outlawed it, but I wasn't aware that California was on the list.

Dealers are selling and shipping items, with lead in the them, in California. They just have to have them tagged and marked showing that the items contains lead.
Really dumb, but that is one of those other political correct things.
There are places ( game refuges, national parks and some public lakes or parks) where lead can not be used, but they are posted, for the most part, and state game regulation books show where
lead shot can and can not be used in hunting and fishing.
If in doubt, ask someone in authority in the area you are going, if you can find someone.

The deal is many bait manufacturers don't want to put a lead warning sticker on the products.
Couple reasons for that, they would have to spend more on decals and apply them to ship specifically to California...(Costs more money to segregate shipments and label)
Or apply them to all packaging and labeling shipped all over the world. (Costs more money, to label everything...)
Creating a potential lead phobia in every other market. (Costing more money in potential sales over the long haul for no good reason...)
So some are choosing just not to sell in Ca.
When this whole labeling/warning thing came out a few years ago it really created a reaction in the industry. Mostly negative, nobody was jumping up and down happy about it.
Another quick cost thought, many baits were designed with lead ballast weights in mind. Just about every venerable crankbait in your box uses lead weights for ballast. Simply substituting out steel for lead won't work because a proper steel weight won't fit in the same hole, and it won't weigh the same. Reworking the mold costs a small fortune, and there is a ton of R&D trying to get that thing to swim right to get the bites again. Its not as easy as just dropping a steel bearing in the bait, and shipping it out for California!
Just a few thoughts from the lure side of the biz.

I order lead products from BPS all the time.. never had a problem with it before.. But I have been buying from Tacklewarehouse latley.

I'm not aware of any lead based paint sold domestically. There are some art clay dyes that contain lead but they're not used in fishing lures. China is another story, who knows what they're putting on.

As for the wheel weights there is an estimates 500,000lbs of lead weights that fall off tires each year in California alone. Weight manufactures have to use something else. I haven't been in the tire business for a while but have recently heard of an internal weight system made of ceramic beads installed inside the tire and do not deteriorate the inside lining. i do not know what the effect is on tire pressure monitoring system (tpms) sensors, but this system works very well especially with a specialty rim and larger tires

2010 is the year both the Montreal Protocols ( o-zone depletion) and RoHS (restrictions of hazardous substances) compliance takes full affect, world wide. You will see a lot of materails (lead) commonly used no longer available or no longer manufactured in the USA, European countries or Japan.

Really what a bunch of crap. My whole family right down to the elders been using lead sinkers for ever without lead poisning.
Lead in paint never hurt anyone. Unless maybe you drink the paint or peel if off the walls and eat it.
However the new generation is scared to death of lead.

Is public awarness of lead poisning good? Sure it is.
Do we need warning stickers on every piece of lead sold?
NO eveyone already knows EATING lead may not be good
Did you know if you drink too much water you can die?

From what I have seen the complaint about lead for fishing is just the sinkers not lures.
I think we should just be aware. after handling raw unpainted lead we need to wash our hands. Do not eat it, do not put in your mouth to pinch a split shot on your line. (I use to do that)
wear a mask if you are melting it or cutting it to protect against breathing fumes or particles. Wear gloves if your handling it for extened periods of time.
Do not sleep with it in your pillow.
like anything else it MAY be harmful if you are not AWARE.

The lures were also subject to the new requirement for labeling because the product contained lead.
The lead bullet ban was added to the Fish and Game code Oct 13th 2007.
Its intent was to preserve the California Condor.
There was a study that showed that bullets contribute to lead poisoning. For example, a shot groundsquirrel left to lie in the field and scavanged would contain fine lead particles which could poison the already state and federally listed as endanged species of condor. Even if the majority of the bullet passed through, there would still be lead in the squirrel. So we now have a nonlead hunting condor corridor, where it is not legal with lead. Ammo companies have been introducing non lead ammo for the shooters affected.
I think its a bunch of baloney, but thats what happened.

Oldschool, are you sure? I thought RoHS only affected European countries and what they could produce and import. I guess I need to follow up on this issue.
