Is it legal to guide without being a licensed guide?
Is it legal to guide without being a licensed guide?
Just curious.
I would rather jog home from my own Vasectomy than spend Saturday at the mall.

Not if you charge, in Oregon you can be fined up to $10,000.00!!
So much tackle, so little money!

That list does not reflect all the guides in the state. If they wish, a guide does not have to have his name listed on that list linked above. If a name doesn't show up there it doesn't mean that they aren't licensed.

Guiding is only "guiding" when money changes hands.
You could certainly guide for free, but I guess you would call that "being frinedly"

plus all the ca.dfg guide permit/license,log book, bond, etc. ,you must have a us coast guard operators license to carry passengers for hire (clients),when you are operating your boat on federal/navigable waterways (delta, colorado river lakes, lake tahoe)!..........

Just thought I would chime in on this to clarify a few things. When you get your guide licsence there is a box on the aplication you check if you want to be Added to there list. Also they must have your ap by the end of February to make the list. You do not need a Coast Guard permit unless you are transfering or guiding six or more people or navigating salt water.

That is false, you are required to have the coast guard license for any "vessel for hire" in USCG navigable waters, including 100% of the delta. Most of the black bass guides lack the proper licensing... Barrack is the only one I know of!!Vince Borges wrote:You do not need a Coast Guard permit unless you are transfering or guiding six or more people or navigating salt water.
Real easy to get the answer...ask the USCG... I have!!!
As most of the illegal delta guides know, enforcement is non-existent!! The issue will become more clear when a liability insurance claim is denied, resulting lawsuit, etc....
Re: Is it legal to guide without being a licensed guide?
also to get your uscg license is no easy task!,$physical exam,$,drug screening,$,application,$ testing,$dmv screening,$,and also now required you obtain a "twic"card (tranportation workers identifacation credential)$$$$$.......

Re: Is it legal to guide without being a licensed guide?
I just called the coast Guard office again to clarify what I was told when Renewing my License. Again they said that no where on the Delta is it required unless you have 6 or more people on board your vessel for hire. That is the third time I have called them on this issue. Not sure who you heard this from but it would be good if you could post it, or the regulation that way more people could become compliant. I first tried to do this 4 years ago thinking that I was not in compliance. they asked me than how many people do I transfer, I told them no more than 3 at a time. I was told that they wouldn't even issue me a License because my boat was only rated for 4 persons. Maybe its an insurance requirement for some company's. Not sure. But I would like to get to the bottom of this. wouldn't want to not be in compliance.

Re: Is it legal to guide without being a licensed guide?
You are in compliance with the law. I have my Calif. guide license and I believe the problem or misunderstanding here is the blending of two agencies in the thinking process. In my bond/insurance paperwork it states no more than 6 passangers but in the regs. I do not see anything that would change that. Maybe Bobby can clear this up. According to my paperwork you are good to go once you are licensed/bonded/and insured.

Re: Is it legal to guide without being a licensed guide?
I do not know Calif. regs for waters navigable by USCG patrolled waters but do have some knowledge, example the Delta is not an inland lake but connected to the ocean via many water ways and rivers and those waters require a Captains License to my knowledge. As to USCG Captains Licenses, the most basic is reffered to as a six pack and limits the captain to no more than six passengers for hire not including the mate or deck hand. An up graded license such as a Masters Licence 50 ton 100ton ect. and an Inspected Vessel are required for more than six passengers for hire as well as different saftey gear up graded life vests fire exts. ect. My understanding is license enforcement on the Delta waters is a grey area so to speak. It takes a lot of work and time to pass all the tests no easy task, and to fill out all the required forms not to mention an expensive process as well I know I went to sea school for a six pack license and have worked as a mate with 28 different Captains.
