Perry's open again to fishing....

I don't have time to write all the details, but the log boom is gone, and the "No Fishing' signs are coming down.

Coast Guard got involved and they contacted State Lands, CG paid a visit and started citing State and Federal law. And ordered the removal of the booms.

This is a big deal, because my last call to Sac. Marine enforcement went really badly. The LEO was telling me the river was private property as it flowed across private land which I knew was not true. He actually refused to discuss the matter further and said, "Whoever you are talking to is giving you bad legal advice..." and hung up on me as soon as he could.

Anyway, score a small victory for your Constitutional right to operate on a navigable waterway, and pursue the fish, which belong to you.

Thank you for your work and effort with this, Andy. It is much appreciated and great to see the system actually working as it should---which sadly has become an uncommon occurance. Great work!

That is cool and I would certainly follow up with the head of the Sac Marine division about it. Seems a lesson on the laws of the water is needed.

Good job and good news. Write up all the details when you get the spare time. It may help us the next time it occurs at a different marina. As it happened to my buddy and I as we were fishing big break marina. A lady come running down the dock and rudely told us that we can not fish there. I ignored her and continued to fish. My buddy asked me if she can tell us not fish there. I replied with a firm hell no she can't. All within earshot of her. She huffed and puffed while i hooked a 4 pounder

Last couple times Ive been there I had troubles. Some zit face kid try to chase my buddy and I off the property. I had just moved into town and my buddy wanted to see big break and visit the Hook since it was right around the corner. We drove up there, parked and got out of the car to look at the ramp condition across the way (I haven't been there in 15 years). He just bought a boat and planned on launching there the next day. Some kid comes out from the office, hollering that we're trespassing and he'll have our car towed. We were parked with other cars where the old Hook was (it was news to me that the Hook moved). He asked us if we can read and pointed to a no trespass sign that was down by the gate. I replied, no, we're a hundred yards away from that sign. Lol. It didn't sit we'll with us so we avoid giving them our business

That place(big break marina) has gone to hell, last I heard the people who own it had filed for bankruptcy, I was hoping to see them gone by now and someone who cared about the place would take up ownership, Gene had the place looking good before the hook moved sad to see all that hard work go to waste......speaking of waste, the people who own that place now live in the yacht tied to the dock, I have heard rumors they do not have a septic system connected to the boat, I quit fishing in there a while back......

Somehow this thread has turned into tresspass on land at Big Break, that could be considered a tresspass.

This thread is about floating on the public waterway within a marina specifically Perry's, and the fact the shoreline owner, or tidal lands owner does not control river traffic or who may float there or fish there from the water.

Also, I was not the only one working on it.

And I don't want to mention any more names if they want to remain anonymous.

I will not stand for people trampling on my rights, period.
I got the ball rolling thru several channels of Boating and Waterways, got shuffled around the Coast Guard for awhile until I got to a certain Lieutenant Commander that was concerned. He requested that I get several photos, of which I did, but his hands seemed tied until I contacted our own Andy Giannini, the master of laws and permits who also contacted the coast guard and local law enforcement.
We could not have done this without Andy's expertise and persistence.
A huge THANK YOU to Andy and everybody here who enjoys our freedom on our waterways also owes Andy a big THANK YOU!
Oh, and did I mention....thanks Andy, you da man!

Big Break marina is bad news. I dont roll there to launch anymore, the people who run it do crazy stuff like that. But in a boat, fishing the marina, they cant say much. Yes they have been living on that boat tied up to the dock for a while now. Its def nothing like what it used to be in the good ol days when the hook was there. Sad
